Not necessarily. The credentials you use to log into Proctor Side are chosen by you at the time you create your Proctor Side profile. You are free to choose any available login ID. This can be the user name that you use for your institution or something completely different. We cannot help recover passwords for your testing website.
Unfortunately, we cannot help you recover the username or password for your testing website.
No, the allotted time for your exam does not begin until the exam has been unlocked by your proctor.
It depends on the rules your institution or organization gave us. Your proctor will be able to tell you the day of your exam if any breaks are allowed and how many you can take. You will also have a chance to go before you start the exam.
Arrive at the time you selected when you scheduled the exam. If you have any technical difficulty or any other problems preventing you from logging in at your scheduled exam time, use Live Chat or call us at +90 (212) 327 27 01 / Ext: 146.
Let us know at least 24 hours before your appoint. If you fail to show up for a scheduled exam without notice, you will not be eligible for a refund. If you reschedule your appointment to be taken within 72 hours of scheduling, you will be charged an additional fee. To avoid it, schedule exams at least 72 hours in advance.
Our proctors cannot secretly access your computer files. With your permission, proctors have the ability to view your screen and utilize the mouse and keyboard as if they were sitting next to you. Once the exam starts, the proctor will monitor everything on the screen, but can no longer use your mouse and keyboard. During the entire process, a chat box is running and you can see what permissions the proctor currently has at any time. The entire chat is saved, including a record of what actions the proctor took while accessing your computer.
Live support is readily available if you are having trouble getting connected with a proctor or other issues preventing you from taking an exam.

Terms of Service

The Terms of Service (herein listed as “Terms”) regulate the user access to and use of Proctor’s (“Proctor Side”, “We”, or “Our”) web-browser extensions, platforms, applications, website(s), and or inclusive of other services (commonly, our “Services”).
The Terms listed below, furthermore, refer to all audio, code, extensions, graphics, information, images, text, video, or other material that is created, uploaded, downloaded, transferred or otherwise appears on or is connected with the Services when you interact with Proctor Side, inclusive of audio or video recorded content from any test sessions (commonly referred to as “Content”).

1. Using Proctor Side’s Services
In order for you to use and utilize our services, you need the compatible hardware equipment, software, including reliable stable internet service. Proctor Side will not be held liable for any equipment or network should a malfunction or service disruption occur, which affects your test period.
By accessing or using Proctor Side’s Services, you agree to adhere to and to be constrained by these Terms. Do not use or attempt to access our Services if you do not agree to the aforementioned and aforesaid Terms.
Proctor Side reserves the right to terminate and end any account or user or and including to suspend or prevent access to the Services, without notice to you, if we have reason to believe you have violated these Terms or if it has been officially instructed to do so by the Assessment Institution for which you are undertaking the test.

2. Basic Terms
You accept responsibility for your usage of the aforesaid Services including any subsequent consequences thereof. The Services are offered to you by Proctor Side for the interest of your contracted company, employer, college, university, instructor, school, organization, certification administrator, or other Assessment delivery partners or associates (hereafter, the “Assessment Institution”).
The content you present, write, enter, speak, click on, post, or display, inclusive of all audio and video recordings or images, inclusive of any recordings or images of you taken by the Services while you are under the test period(s), will be available and distributable with and viewable by your Assessment Institution.
The Services offered by Proctor Side may only be used if you agree to adhere to and comply with the Terms listed here and any pertinent local, region, national, and international laws, rules, and regulations. The type or form of Services offered or provided by Proctor Side can and may change from one period of time to another without advance notice to you. Furthermore, Proctor Side may cease (permanently or temporarily) providing its Services (or any features within the Services) to you without any advance notice.
As a user of the Services, you are forbidden from photographing, or recording, either by video or sound, any part of Proctor Side’s Services for any purpose, unless Proctor Side explicitly grants you express written permission to do so. You are forbidden from removing copies of test questions or test answers, and you are forbidden from sharing, discussing, or revealing the test questions and answers, or test content which you viewed during your test.

3. Privacy
Proctor Side is entitled to adjust our fees from time to time, without providing advance notice. The latest fee schedule is available from your Assessment Institution and it is fully incorporated thereof by reference. The incorporation of the fee schedule, reference, includes any changes to pricing structure or the availability of choices in services. Barring the payment of your test period fees directly to us by your Assessment Institution, you are liable for all fees and associated costs with your usage of our Services, including the fees for our “Proctor Side Plus” (premium) services which you may have selected.
Proctor Side’s current Privacy Policy (available here) is explicitly incorporated into these Terms by reference. Your usage of the Services and any of the related Content that you provide during your interchange or interaction with Proctor Side is subject to our Privacy Police, which dictates how any information you provide and any Content you submit is collected and forwarded to the Assessment Institution with-which you are necessitated to be tested for.
4. Identity Authentication
Through your selection in use of the Services, you accede and assent to provide only factual and true information to validate your identity.

5. Connecting to your device
When you use the Services, Proctor Side will establish a remote connection to your device in order to establish a mechanism to observe and invigilate your computer screen and your premises. As a part of using the Services, you agree to use your camera to rotate and survey your premises using your digital web camera if or when a proctor requests that you do so. The proctor will provide you with reasonable instructions on how to properly and correctly scan the room within which you will be seated during your test. You agree to maintain the audio and video connection with the proctor during the duration of test period, to enable the Services to record your test period, and to disconnect audio and video contact from the test period upon completion of your test. You assent for us to make all and any recordings of any Content from your examination or test period available to your Assessment Institution.
If you display impermissible behavior during your test period, Proctor Side retains the right to deny service and report your actions to your Assessment Institution. By choosing to use Proctor Side’s services, you understand and concede that the proctor may immediately terminate your test period if the proctor experiences or observes:
1. Any activity that would warrant a terminable offence based upon the agreement between the Assessment Institution with which you are being tested and Proctor Side; or
2. Any conduct that the proctor may consider vulgar, offensive, pornographic, obscene, abusive, criminal, otherwise inappropriate, or scurrilous.
Upon choosing to use the Services, you confer upon the proctor the right to use whatever method Proctor Side makes available to recommend that your examination or test be disqualified if or when the proctor detects suspicious or questionable action(s) during the test period.

 

6. Accounts and Passwords
In order for you to utilize our Services, we may require you to register with Proctor Side and to create a user account.
Upon creating your account, you are consent to: (i) provide true, accurate, up-to date, factual, and complete information about yourself and (ii) maintain and promptly update your registration information to maintain its veracity, accuracy, and ensure to keep it current, and complete. Proctor Side, at its sole discretion, has the right to immediately suspend, interrupt, or terminate your account and refuse any and all current or future use of the Services (or any portion thereof) if:
1. You supply any information that is not true, not accurate, not current, or not complete; or
2. Proctor Side has reasonable reasons to suspect that such information is not true, not accurate, not current, or not complete; or
3. You provide fallacious information.
You are responsible in maintaining the confidential nature of your account credentials, including your password. If you suspect that your password is no longer safe or it may have become compromised, you must promptly change your password and promptly notify us by contacting sending an email to support@proctorside.com

7. Content
You are wholly held responsible for any Content that you create and submit while using the Services. Because Proctor Side does not control user-generated Content submitted via the Services, we cannot assume responsibility for such Content. By submitting, transferring, posting, or displaying Content on or through the Services, you authorize Proctor Side to utilize, transmit, display, save, and distribute such Content to your Assessment Institution.
You are wholly responsible for how you use the Services, any Content you provide, and any resultant consequences, inclusive of the disqualification of your test by your Assessment Institution.
Proctor Side is not and will not assume responsibility or liability for how the Assessment Institution with which you have chose chooses to use your Content you submit herein. When you use the Services, you represent and declare that you have all the authorizations, power, privileges, and necessary authority to consent your Content.

8. Proctor Side Intellectual Property Authorizations
Our Services include intellectual property that is wholly owned by Proctor Side and our licensed service providers, inclusive of but not restricted to, printed digitized text, design or elements of design, graphic images or symbols, logos, button icons or images, images, audio clips or segments, digital downloads, interfaces, data compilations, proprietary software, proprietary code, content and the layout, overall system coordination, and arrangement of our Services.
All intellectual property authorizations in our Services are protected by pertinent and relevant Republic of Turkey.
Through the use of the Services, you accept and allow that any questions, comments, suggestions, ideas, feedback, or other information about our Services (“Submissions”) that you send to Proctor Side are voluntarily submitted and are non-confidential, and you agree that Proctor Side is entitled to the unlimited usage and distribution of these Submissions for any purpose, commercial or otherwise, without express acknowledgment or recompense to you.
Neither the Services nor any portion thereof may be revised, duplicated, recreated, amended, downloaded, published, transmitted, transferred, sold, or distributed in any form except as described in these Terms. You agree to abide by all copyright and other international laws in your use of our Services and to prevent any unofficially sanctioned copying of any Content from our Services.
You are conferred a non-exclusive and non-transferable authorization to electronically enter and use the Services only in the manner described in these Terms. Proctor Side does not sell to you, and you do not have the right to sublicense, any Proctor Side intellectual property. You accept and assent that Proctor Side retains full authorizations to alter the Content or technical specifications of any part of the Services, at its sole discretion. Proctor Side may annul, nullify, rescind, or terminate this license at any time, without notice or liability. We will not be liable if, for any reason, all or any part of the Services become unavailable or inaccessible.
No other privilege, title, or interest in or to the Services is transferred to you, and Proctor Side retains all authorizations not expressly conferred herein. Any use of the Services not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws. If you print, copy, alter, download, or otherwise use or provide any other person with access to any part of the Services in a manner that breaches these Terms, your right to use the Services will terminate immediately.

9. Links
The Services may include web links to third-party websites or resources outside of Proctor Side’s domain.
By using the Services, you assent and agree that Proctor Side is not responsible or liable for: (i) the availability or correctness of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources.
The inclusion of links to such websites or resources does not imply Proctor Side’s endorsement of such websites nor resources nor the content, products, nor services available therein. By agreeing to use the Services, you assent that you are solely responsible for and assume all risk arising from your use of any such third-party websites or resources.
You may provide a link to our Services, provided you do so in a way that is fair and legal and does slander or defame our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any type of relationship, agreement, or authorization on our part.

Subject to the aforementioned, you must not:
1. Set-up or connect a link to our Services from any website that is not owned by you; or
2. Cause our Services or any portions of it to be displayed, or appear to be displayed, by any other site, for example, framing, deep linking, or in-line thinking, on any other site; or
3. Otherwise take any action with respect to our Services that is inconsistent with any other provision of this Agreement.
You consent to cooperate with us and immediately stop any linking when instructed to do so by Proctor Side. We reserve the right to rescind linking permission with no prior notice.

 

10. Warranties
You affirm and declare all information you provide when downloading, registering for, registering, entering, or otherwise using our Services and all information that you thereto provide regarding yourself is true and factual and not fallacious or misleading.
You access and agree to use the Services and the Content at your own risk. Proctor Side offers no warranty, express or implied, regarding any error or omission and assumes no liability for loss or damage resultant from using or the inability to use the services. You understand and agree that the Services are provided to you on an AS IS, WITH ALL FAULTS, and AS AVAILABLE basis.
Neither Proctor Side nor any of the companies related with it, nor any of our associates or representatives assert any claim of guarantee or warrantee with regard to the completeness, veracity, availability, timeliness, security, or the reliability of the services or any Content therein. Neither Proctor Side nor anyone related with Proctor Side represents or warrants that the Services will be accurate, reliable, error-free, uninterrupted, free of transmission errors, that defects will be corrected, that the Services are free of viruses or other harmful components, or that the Services will otherwise meet your needs or expectations.
When you agree to use our Services, any information that you submit will be transmitted through the world wide web (internet) and such transmission is beyond our ability to control. Proctor Side does not accept any responsibility nor is it liable for the deletion of, or the failure to save or to transmit, any Content and other communications maintained by the Services. Proctor Side does not accept any liability for loss or damage to your computer systems, devices, or networks as a result of your usage of the services. Proctor Side will not be held liable for any loss or damage caused by a distributed denial-of-service attack, virus, or other technologically harmful material that may infect your computer equipment, computer programs, devices, or data due to your use of the Services.
No advice or information, whether verbal nor written, obtained from Proctor Side or through the Services, will create any warranty that has not been expressly and explicitly made herein. YOUR SOLE REMEDY AGAINST Proctor Side FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THE SERVICES.
Without limiting the foregoing, Proctor Side DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Proctor Side will not be liable for any delay or failure in performance of the Services.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use of the Services, for any cause of action.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EITHER Proctor Side OR ITS SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, OR EMPLOYEES, BE LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, STATUTORY, PUNITIVE, OR EXEMPLARY DAMAGES. SUCH DAMAGES MAY INCLUDE, BUT ARE NOT LIMITED TO, LOST PROFITS, LOST SAVINGS AND LOST REVENUES, LOSS OF USE, LOSS OF TIME, SHUTDOWN OR SLOWDOWN COSTS, INCONVENIENCE, LOSS OF BUSINESS OPPORTUNITIES, EMOTIONAL HARM, DAMAGE TO GOODWILL OR REPUTATION, OR OTHER ECONOMIC LOSS.
12. Exclusions
Some jurisdictions do not allow the exclusion of certain guaranties, warranties, or the limitation of liability for consequential or incidental damages. Therefore, any warranty exclusion(s) and/or limitation(s) of liability will not apply to any users who are subject to such pertinent prohibitions. All other warranty exclusions and limitations of liability will remain in full force and effect.
13. Indemnity
By using the Services offered by Proctor Side, you agree to defend, indemnify, and hold harmless Proctor Side, Proctor Side representatives, our officers, directors, stockholders, employees, agents, contractors, partners, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses arising from your breach of these Terms, your illegal conduct, or your violation of the authorizations of any third party, inclusive of authorizations available under our agreements with any Assessment Institution or other third party. Those claims, liabilities, damages, losses or expenses may include, but are not limited to, reasonable attorneys’ fees, court costs, and costs that arise out of or are in any way connected with your access to or use of the Services, your violation of or failure to perform any obligation under these Terms, or your violation of any authorizations of any third party.
14. Waiver and Severability
Proctor Side’s failure to exercise or enforce any right or provision of these Terms will not be regarded as a waiver of its right to the benefits associated with such right(s) or provision(s). No waiver by Proctor Side of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
In the event that any provision of these Terms is held to be invalid or unenforceable by any pertinent law, rule, order, or regulation of any government, or by the final determination of any national court, such provision shall be ineffective only to the extent of such invalidity, and shall not affect the enforceability of any other provision in these Terms.
15. Controlling Law and Jurisdiction
All Terms and any claim or action arising out of or in any way related thereto will be governed by the laws of the Republic of Turkey without regard to or application of its conflict of law provisions. All claims, legal proceedings, or litigation arising out of or in connection with or related to the Services will be brought solely in a court of legal jurisdiction in the Republic of Turkey, City of Istanbul.

16. International Use of Services
These Services are created, operated, and controlled by Proctor Side from the Republic of Turkey. Proctor Side makes no claims that the Services are appropriate for use outside of the Republic of Turkey. You may not use the Services or any component of the Services in violation of The Republic of Turkey or foreign export laws and regulations. Access to the Services may not be legal in certain countries outside the Republic of Turkey. If you use the Services from outside the Republic of Turkey, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

17. Modification to Terms
Proctor Side may modify these Terms at any time at its sole discretion by changing, adding to, deleting from or otherwise updating them. Proctor Side will and provide notice of changes to these Terms by posting them on our Services or by any other means available under pertinent law. Any such revisions become effective immediately and supersede and supplant any previous version of these Terms. You should visit these Terms from time to time to review the current Terms because they are binding on you. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms. It is your duty to be familiar with the Terms that are in effect at the time of your use.

The current Terms supersede and supplant any previous version of the Terms. By continuing to use the Services after we provide notice of any change, you agree that your access and use of the Services is the functional equivalent of your signature and you hereby waive any objection to electronic assent to this agreement, whether based on the Statute of Frauds or similar law, rule, or regulation. A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to use of these Services to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

18. Supplemental Agreements
Certain provisions of these Terms may operate in conjunction with expressly designated legal notices, agreements between Proctor Side and your Assessment Institution, or terms located on particular pages or components of Proctor Side’s Services (each a “Supplemental Agreement”). In the event of a conflict or inconsistency between these Terms and a Supplemental Agreement governing or otherwise concerning your use of Proctor Side’s Services, the provisions of the Supplemental Agreement shall prevail, unless Proctor Side expressly agrees otherwise in writing. Proctor Side will not retain or use your personal data for a period or in a manner inconsistent with the retention or use your Assessment Institution permits under any Supplemental Agreement.”
